How do you tell if the guy in the photograph is dead or just sleeping?

I live in Vancouver but did not see these photos. But from the article you linked to, it sounds like these images were just taken off the internet. I wonder, if that is the case, if using them is a copyright violation. And were model releases obtained for these? If I was the subject of one of these less than flattering images, I would certainly not want my mug posted on a billboard!

They are disturbing! Landscape photography has the power to heal, portrait photography sends you to hospital... imho
